SleepExpertly respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our website.

Copyright Policy

It is our policy to:

  • Respond to notices of alleged copyright infringement that comply with the DMCA
  • Promptly remove or disable access to material that is claimed to be infringing
  • Terminate, in appropriate circumstances, the accounts of repeat infringers

Filing a DMCA Notice of Copyright Infringement

If you believe that content on SleepExpertly infringes your copyright, you may submit a DMCA takedown notice. To be effective, your notice must include the following information:

  4. A statement of good faith belief: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. A statement of accuracy: A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf.
  6. Your physical or electronic signature: A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest.

Important Notice

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. If you are unsure whether the material you are reporting is infringing your copyright, you should contact an attorney before filing a DMCA notice.

Counter-Notification

If you believe that material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. To be effective, a counter-notification must include the following:

  1. Identification of the material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  2. Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your contact information: Your name, address, and telephone number.
  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which the website may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Your physical or electronic signature: Your physical or electronic signature.

How to Submit a Counter-Notification

Please send your counter-notification to our designated Copyright Agent at the same contact information provided above, with the subject line "DMCA Counter-Notification."

What Happens After We Receive a DMCA Notice

Upon receiving a valid DMCA notice, we will:

  1. Remove or disable access to the allegedly infringing material
  2. Notify the user who posted the material that it has been removed or disabled
  3. Provide the user with a copy of the DMCA notice
  4. Inform the user of their right to file a counter-notification

What Happens After We Receive a Counter-Notification

Upon receiving a valid counter-notification, we will:

  1. Forward the counter-notification to the party who submitted the original DMCA notice
  2. Inform that party that we will restore the removed material in 10-14 business days
  3. Restore the material in 10-14 business days, unless our Copyright Agent receives notice that the original complainant has filed a court action seeking to restrain the user from engaging in infringing activity

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
